


One issue before the court was whether Hyperion had enough contacts with the state of Arkansas for the court to exert personal jurisdiction. The Eighth Circuit affirmed in part and reversed in part. The district court stayed discovery pending its ruling on motions to dismiss by the defendants and then went on to dismiss all the claims against all of the defendants. The plaintiff filed suit in Arkansas for invasion of privacy and intentional infliction of emotional distress against the author, Hyperion, Disney Publishing Worldwide, HBO and Time Warner. A fictionalized version of the blog was published as a book of the same name by Hyperion Books and was optioned by HBO for a potential television series. Defendant Jessica Cutler wrote a blog called The Washingtonienne in which she chronicled her sexual relationships with several men in Washington D.C.
